Privacy Policy and Terms of Use

REALpac Energy Benchmarking Program and Water Benchmarking Program Privacy Policy

The privacy of REALpac members, customers, and employees is of great importance to REALpac.  REALpac recognizes the importance of maintaining anonymity for all building data that is submitted to the REALpac Energy Benchmarking Program or the REALpac Water Benchmarking Program in either a Multiple Buildings Template format, and/or directly entered within the REALpac Energy & Water Normalization Database, or submitted in any other format.

The policy below specifically addresses the privacy of building data and/or other information which may indicate the identity of the building or owner/manager of the building.

Identifying Purposes for Collection of Information
REALpac will identify the purpose for which building information is collected at or before the time the information is collected, unless the purpose has been previously identified.  Specific uses of the information that can reasonably be described as falling within the realm of the original purpose will not be further identified explicitly.  It is the responsibility of the persons or entities submitting data to obtain clarification regarding potential additional uses of the data before they submit, if they are uncertain.

Information collected may also be used for the purpose of internal reporting in order to identify industry trends in activities or building data, or to gauge general usage statistics for the betterment of REALpac services and offerings.

Any and all data analyses REALpac may perform for third-parties outside of REALpac will comply with the privacy policy, as stated herein.  In those circumstances where the purpose for which building information is collected, the use of such information has not been previously identified and the data that will be disclosed is not able to be anonymized such that the individual building and/or building owner/manager is identifiable, consent for the use and disclosure will be sought after the information has been collected, but before it is used.

Information Collection and Use
REALpac does not automatically gather any personal information, such as an individual’s name, telephone number, email, or address.  This information is only obtained if you supply it voluntarily, through accepting the REALpac Energy Benchmarking Program or the REALpac Water Benchmarking Program Terms of Use in order to gain access to the REALpac Energy & Water Normalization Database, by registering on or visiting our website to download documents, by entering data and sharing information, or by contacting us via e-mail, regular mail, or facsimile.

REALpac does not automatically collect building or organizational data.  This information is only obtained if you supply it voluntarily.  Voluntary data entry processes include accepting the REALpac Energy Benchmarking Program or the REALpac Water Benchmarking Program Terms of Use in order to gain access to the REALpac Energy & Water Normalization Database and/or by registering on or visiting our website to download documents, and/or by entering and submitting building data in any format to REALpac via email, Multiple Building Template, direct entry, or other method.  Submissions in formats other than the Multiple Building Template or entry into the REALpac Energy & Water Normalization Database may be accepted and would also be considered voluntary.

Obtaining Consent for Collection, Use, or Disclosure of Information
REALpac will obtain consent, either express or implied, for the collection and subsequent use and disclosure of building information at the time of collection of the information.  Disclosure of building information will be done anonymously and in an aggregated format so that the identity of the building and/or building owner/manager/submitting entity is not revealed or shared outside of REALpac.  The submission of data to REALpac (in any format) in connection with the REALpac Energy & Water Normalization Methodology/Template/Database or the REALpac Energy Benchmarking Survey or the REALpac Water Benchmarking Survey will constitute implied consent to the collection and use of the enclosed data by REALpac, as per the terms set out herein.

REALpac will determine in its sole discretion the type of consent, if any, for future activities that may be required based on the type of information collected, its intended use, and the sensitivity of the information.  Consent may be expressed or implied, given orally, electronically, or in writing.  An individual or submitting entity may withdraw consent at any time on sufficient notice to REALpac subject to legal and contractual obligations. The individual or submitting entity will be notified by REALpac of the implications of this withdrawal.

Customer Services
Information we obtain from you, such as your name, address, telephone number, or email address, will only be used to process your requests for products, services, and information.  All REALpac employees who are granted access to customer records understand the need to keep this information protected and confidential and to use the information only for the purposes intended.
Specifically, in the collection of building energy use data and related contact information, REALpac employees who are granted access to the building energy data records understand the need to keep this information protected and confidential and to use the information only for the purposes intended or agreed upon through the granting of consent.

Disclosure
REALpac will not sell, share, transfer, or otherwise provide individual building information to any third parties, except as may be required by law.  Furthermore, no individual data collected by REALpac through the submission of building energy use data within the REALpac Energy & Water Normalization Template/Database, or other formats to be used in the REALpac Energy Benchmarking Survey or the REALpac Water Benchmarking Survey, will be sold, shared, transferred, or otherwise provided to any third parties, outside of REALpac.  The only type of data that will be disclosed outside of REALpac is that which is anonymous and aggregated such that the individual building and/or building owner/manager cannot be identified.

Confidentiality and Security
REALpac limits access to personal and building information to employees who it reasonably believes need to have such information in order to provide products and services to external organizations.

REALpac takes all commercially reasonable steps to protect the confidentiality of personal and building related information.  We have technological and operational security policies and procedures in place to protect personally identifiable information from loss or theft, misuse, unauthorized access or disclosure, copying, alteration, or destruction.

Our website may contain links to other websites. REALpac is not responsible for the privacy practices of other websites.  We recommend that if you choose to go to another website by way of a link found on the REALpac website, you read the applicable privacy policy or policies with respect to such site or sites.


REALpac Energy Benchmarking Program Terms of Use

By using the REALpac Energy Benchmarking Program or the REALpac Water Benchmarking Program website, REALpac Energy & Water Normalization Database, and/or by clicking on “I accept”, or by downloading any material, you agree to be bound by the following terms of use as an agreement (the “Agreement”) between you and the Real Property Association of Canada ("REALpac").  If you are entering into this Agreement on your employer's behalf, this Agreement applies both to you and to your employer.  REALpac reserves the right to change this Agreement from time to time at its sole discretion.  Your use of any and all related documents and materials will be subject to the most current version of this Agreement posted on the REALpac Energy Benchmarking Program website or the REALpac Water Benchmarking Program website or within the online Database at the time of such use.

REALpac Energy Benchmarking Program Terms of Use Agreement – Version 3.0 – April 2015

  1. All material found in this and other related documents, the pages of the REALpac Energy Benchmarking Program website or the REALpac Water Benchmarking Program website, within the downloadable documents contained on this website, and/or within the REALpac Energy & Water Normalization Methodology/Template/Database is protected under the copyright laws of Canada.  Certain names, words, titles, phrases, logos, icons, images, graphics, or designs in the pages of this website may constitute trade names, trademarks, images, or service marks of REALpac.  The display of trademarks, trade names, images, or service marks on pages on this website does not imply that a license of any kind has been granted to you or to anyone else.  You are bound by this Agreement when you access this and other related documents and/or our website and until you have destroyed all content that you have downloaded from, or copied from, or submitted to our website; you are, in addition, bound by this Agreement whether you accessed, submitted, utilized, downloaded or copied the content under the terms of this Agreement or otherwise.
  2. You are free to download the free material posted on the REALpac Energy Benchmarking Program website and/or the REALpac Water Benchmarking Program website and/or the REALpac Energy & Water Normalization Database.  You are free to use and reference the material contained in our documents.  You agree that you do not acquire any ownership rights in any downloaded content.  You may not distribute copies of the material for any purpose or 'frame' it in any site you create or operate unless you do so with the prior written consent of REALpac or its affiliates.  You agree to abide by all copyright notices, information, and restrictions contained in any content on these websites.

  4. Any unauthorized re-transmission, alterations, reverse engineering, or sale for commercial purposes of any material in this and other related documents or posted on the REALpac Energy Benchmarking Program website or the REALpac Water Benchmarking Program website, including that contained in the REALpac Energy & Water Normalization Methodology/Template/Database, may violate federal, common or civil law trademark law and copyright law, and may result in legal action.  In addition, you may not remove any REALpac logo, word mark, or copyright mark from any materials in order to pursue unauthorized activities, as described above.
  5. Acknowledgement must be given to REALpac in any materials, presentations, or papers associated with any intellectual property of REALpac, including the REALpac Energy and/or Water Normalization Methodology and/or Template and/or Database and/or other related documents and any prior versions or formats of such.
  6. REALpac may make changes to any document or webpage at its sole discretion at any time without notice.  REALpac may also make changes to the Methodologies, Database, underlying formulas and calculations, policies and/or processes, fees, deadlines, or other item related to the REALpac Energy Benchmarking Program or the REALpac Water Benchmarking Program at its sole discretion at any time without notice.  In addition, any data that has been entered and saved within the REALpac Energy & Water Normalization Database may be removed or deleted from the Database, partially or entirely, at anytime without notice if REALpac deems it incorrect, not credible or reliable, inaccurate, or ineligible to participate in the Energy & Water Benchmarking Survey.
  7. REALpac will not sell, share, transfer, or otherwise provide individual building information to any third parties, except as may be required by law or in the case where the data disclosed to third parties is anonymous and aggregated such that the individual building and/or building owner/manager cannot be identified.  Data/information supplied voluntarily to REALpac through the REALpac Energy Benchmarking Program or the REALpac Water Benchmarking Program  may be used for other purposes than initially supplied for, but such uses shall ensure that the data/information will not identify individual buildings and/or building owners/managers.
  8. Users make use of the information contained within this and other related documents, the REALpac Energy Benchmarking Program website or the REALpac Water Benchmarking Program website and/or the REALpac Energy & Water Normalization Methodology/Template/Database at their own risk and there is no warranty express or implied as to fitness for purpose.  REALpac will not be liable for any damages, direct or other, as a consequence of using the REALpac Energy Benchmarking Program website or the REALpac Water Benchmarking Program website and/or the REALpac Energy & Water Normalization Methodology/Template/Database or any of its content or related materials.
